NWAonline’s Skip Descant reports that Billy Joe Bartholomew, owner of the former Washington County Livestock Auction, has filed a motion to dismiss his lawsuit against the city of Fayetteville.
After years of operating the sale barn, Bartholomew sought to sell the property to Campus Crest LLC, a company that wanted to build student housing on the land. But, the deal was contingent on rezoning the property to Downtown General, which would allow for residential uses.
In a vote 4-3, aldermen rejected the proposed rezoning prompting Bartholomew to file a lawsuit.
With the possibility of a lengthy litigation process in store, Bartholomew says Campus Crest is no longer interested in the property.

This makes me sad. I think the city was in the wrong in the rezone denial. It would have been nice to hear an unbiased judicial decision on if what the city did was right or wrong.
