A meeting of the Fayetteville City Council began at 5:30 p.m. Tuesday, Feb. 17, 2015 inside room 219 of the City Administration Building, located at 113 W. Mountain Street in Fayetteville.

Garver, LLC (PDF): A resolution to authorize a professional engineering services agreement with Garver, LLC for final design services for water and sewer relocations associated with Arkansas Highway and Transporation Department project BB0414 – Interstate 49 and Highway 112 interchange in an amount not to exceed $102,742.50, and to approve a budget adjustment.

Watershed Conservation Resource Center Task Order No. 2 (PDF): A resolution to approve task order No. 2 with the Watershed Conservation Resource Center for continued maintenance of previously completed stream restoration projects at Niokaska Creek and the White River through 2015 in the amount of $62,500.00, and to approve a budget adjustment.

Bid #15-16 Cam Lawn Services, LLC (PDF): A resolution to award bid #15-16 and authorize a contract with Cam Lawn Services, LLC in the amount of $149,191.00 to plant trees and shrubs in the median of Crossover Road between Township Street and Joyce Boulevard and in the median of Garland Avenue between Mount Comfort Road and Janice Avenue, and to approve a project contingency in the amount of $15,000.00.

* Alderwoman Marsh requested that this item be split into two votes – one that occurred tonight to rezone the 33.38-acre request to RSF-8, leaving the other 59.66-acre request to be sent to the Environmental Action Committee for a recommendation before a final council vote is taken. Alderman Long said it would be March before the item could be considered by the EAC. Alderman La Tour asked if staff thought the property owner would mind the delay. Staff said the property is owned by a bank, so it won’t likely be an issue, especially considering the rezoning petition was a staff-initiated action.

4. RZN 14-4916 (956 Ray Avenue/Hodous) (PDF): An ordinance rezoning that property described in rezoning petition RZN 14-4916, for approximately 0.32 acres, located at 956 Ray Avenue from RMF-24, Residential Multi Family, 24 units per acre, to NS, Neighborhood Services.

U.S. Geological Survey (PDF): An ordinance to waive the requirements of formal competitive bidding and authorize a joint funding agreement with the U.S. Geological Survey for stream gauge installation, operation and maintenance and water quality sampling and monitoring at various locations in the City of Fayetteville for 2015 with the amount paid by the city not to exceed $61,721.00.

University of Arkansas Utility Relocation Agreement (PDF): An ordinance to waive the requirements of formal competitive bidding and approve a utility relocation agreement with the University of Arkansas for the relocation of copper and fiber optic cables necessary for the Highway 112 widening project between Razorback Road and Garland Avenue with the amount to be paid by the City of Fayetteville not to exceed $33,476.50.

9. Walton Arts Center Council, Inc. (PDF): An ordinance to waive the requirements of competitive bidding and authorize a contract for educational, entertainment and administrative services in 2015 to the Walton Arts Center Council, Inc. in the amount of $250,000.00.

Alderman La Tour said he’s concerned that the city is spending money with the Walton Arts Center while there are two jobs in the police and fire departments that are frozen. Alderman Kinion said this money would come from a fund created specifically for uses like the one suggested, and are not to be applied to the police department employee budget. La Tour moved to reappropriate these funds to the police department, but there was no second for his motion. Staff said both the police and fire departments are staffed to all required standards in every division, and that the positions Alderman La Tour referred to are being staffed by current employees at overtime rates. Fire Chief David Dayringer said an internal study showed it is currently more efficient to staff those positions using overtime pay than to hire a full-time employee. Both Dayringer and Police Chief Greg Tabor said if at any time they felt public safety was in jeopardy, they would come to the council with a request to unfreeze those two positions.

Alderman Long moved to amend the contract so it would be re-introduced and re-approved each year instead of having it auto renew (with council approval) each year for three years. Long’s amendment failed 3-4 (Gray, Marsh, Kinion, and Petty voted against).

The item passed 6-1 (La Tour voted against).

10. Associated Time & Parking Controls Spring Street Parking Deck (PDF): An ordinance to waive the requirements of formal competitive bidding and authorize the purchase of digital parking equipment from Associated Time & Parking Controls in the amount of $98,805.95 for the Spring Street Parking Deck.

* Alderman Tennant said it’s important to note that Associated Time & Parking Controls is buying back the gating equipment that’s being replaced in the area, and those funds will be used to purchase the new kiosks.

11. Associated Time & Parking Controls West Avenue Parking Lot (PDF): An ordinance to waive the requirements of formal competitive bidding and authorize the purchase of digital parking equipment from Associated Time & Parking Controls in the amount of $66,985.91 for the West Avenue Parking Lot.

* This change will ensure that all city-owned paid lots in the Dickson Street area use the same system. Staff said the gates in the West Avenue (WAC) lot are broken on an almost nightly basis, and that customers have indicated they like the kiosks better anyway.

12. Gulley Park Two Single-Family Lot Sale (PDF): A resolution to authorize Mayor Jordan to offer for sale approximately 1.25 acres of city-owned real property on Old Wire Road near Gulley Park.
